Man charged with pulling handgun on repo man

A 59-year-old man was arrested after police say he pulled a handgun on a repo man that was towing his vehicle.

Michael John Malone, 59, was charged with aggravated assault with a deadly weapon, a second-degree felony.

The assault was reported to the Odessa Police Department at 2:22 a.m. March 15 in the 100 block of E. 52nd Street, an OPD probable cause affidavit detailed.

Officers made contact with the complainant, identified as Miguel Angel Mota, who told police he was at the scene to repossess a vehicle later found to belong to Malone. Mota stated that as he was about to tow the vehicle, Malone ran up to him and ordered him to put the vehicle down.

Mota stated that when he refused, Malone drew his black Smith and Wesson M&P .45 handgun and struck Mota’s vehicle with it and then pointed the firearm directly at him causing him to fear for his life, the affidavit stated.

Police say they made contact with Malone, he was detained in handcuffs and was read his Miranda Warning, to which he stated he understood and wished to continue with the interview. Malone admitted that he drew his firearm and struck Mota’s vehicle with it, but stated that he kept the barrel of the firearm pointed directly to the ground.

The probable cause affidavit details that Malone admitted there was no immediate need for him to draw his firearm at any point in time.

Malone was arrested and booked into the Ector County Law Enforcement Center on March 15, jail records show. He has one bond totaling $25,000 and was still in custody as of Thursday afternoon.
