Man arrested on suspicion of murder faces additional charges

A 31-year-old Odessa man arrested last month on suspicion of murder is now facing sexual assault and drug charges.

Harvey Gutierrez was arrested Dec. 29 in connection with the death of Maurice Rogers, 36.

Officers went to check on Rogers Dec. 28 when he didn’t show up at work and they found his body inside his East 36th Street home.

According to Odessa Police Department reports, Gutierrez told detectives Rogers’ sons attempted to rob him and he, the teenager and Ashton Isiah Munoz, 18, conspired to shoot up one of the son’s cars, but Rogers ended up being shot instead.

Gutierrez was released from the Ector County jail Jan. 2 after posting a $100,000 surety bond, but he was re-arrested Jan. 16 on suspicion of possession of a controlled substance and sexual assault of a child charges.

OPD records indicate that when detectives interviewed Gutierrez about the murder, he spoke about a former girlfriend of his and they discovered a sex video and photographs of the former girlfriend on Gutierrez’s phone. They also learned the former girlfriend was 16 at the time the two were dating.

When they spoke with the former girlfriend, she told them she lived with Gutierrez from July 2022 until Dec. 15, 2022, he knew she was 16 and she identified the two people in the video as herself and Gutierrez, the report stated. She also told detectives she and Gutierrez spoke about the illegality of their sexual relationship.

Gutierrez was released from the jail Tuesday after posting two more surety bonds totaling $52,000.

Munoz was released from the Ector County jail on a $200,000 surety bond Jan. 9. The juvenile remains at the Ector County Youth Center.
