Man accused of assaulting peace officer

Odessa Police allege a 34-year-old man facing a misdemeanor public intoxication charge made things a lot worse for himself by stomping on a police lieutenant’s foot Saturday night. If he’s convicted, he could get two to 20 years in prison.

According to an OPD report, Isiah Martin Garcia got into an argument with other patrons at Basin Nights on Kermit Highway shortly after midnight and things got physical when he refused to leave.

OPD officers handcuffed Garcia and when they were walking him to a patrol car, he stomped on the top of a fully uniformed lieutenant’s foot, causing the 45-year-old to start limping in pain, the report stated.

Garcia was arrested on suspicion of assault on a peace officer, a second-degree felony, in addition to the public intoxication charge, which carries a fine of up to $500, but no jail time.

Garcia, who has past convictions for driving while intoxicated, possession of marijuana and unlawfully carrying a weapon, was released from the Ector County jail later in the day after posting surety bonds totaling $25,312.
