Father files lawsuit following death of seven-year-old

The father of a 7-year-old Lubbock girl who was killed last September in a Midland crash has filed a lawsuit against the driver and his employer, Vulcan Transportation.

According to the lawsuit filed Thursday in Ector County District Court, Mariah Jaramillo was driving a Dodge Durango with her three children on Craddick Highway Sept. 10, 2022 when she was struck by a tractor trailer while pulling onto State Highway 349.

The lawsuit alleges the driver of the tractor trailer, Yurian Orea Rodriguez of Odessa, was on SH 349 and had his right turn signal on, leading Jaramillo to believe he was turning onto Craddick Highway. It further alleges Rodriguez’s brakes weren’t working properly.

Aniyah Gomez died eight days after the crash and three weeks before her seventh birthday, the lawsuit stated. Her sister, Aaleyah, 9, had to undergo surgery for multiple fractures and 3-year-old Adalynn, suffered fractures to her skull and collar bone.

The lawsuit alleges Rodriguez was asked to preserve the tractor trailer in the condition it was the day of the wreck, but he removed all of the tires from it, thus destroying evidence.

Robert Gomez is seeking unspecified damages on behalf of all three of his daughters.
