Drive-by shooting leads to arrest

A 37-year-old Odessa man was arrested early Tuesday morning after officers found evidence he opened fire on a home occupied by his estranged wife, two children and an 18-year-old woman.

According to an Odessa Police Department report, a resident in the 1100 block of West Ada Street called 911 shortly after 3 a.m. to report that Ivan Garay had just fired into her home.

When officers arrived, Garay’s 35-year-old estranged wife told them she suspected Garay had committed the drive-by shooting because she’d spotted Garay’s avocado green Chevrolet Silverado outside her house moments before the shots were fired, the report stated.

In addition, she said he’d threatened her earlier that night because she’d been ignoring his texts and phone calls, the report stated.

Officers found 15 rifle casings on the sidewalk in front of the home and numerous bullet holes throughout the interior of the house, the report stated.

When contacted by phone, Garay said he was home sleeping, but when officers arrived at his house on West May Street, his Chevy was warm to the touch, the report stated.

In addition, officers found a rifle magazine containing shell casings matching those at the crime scene, the report stated.

Garay said he probably had gunshot residue on his hands, but only because he’d shot an assault rifle last week, according to the report.

Garay was arrested on suspicion of aggravated assault with a deadly weapon and three counts of deadly conduct. He was also arrested on suspicion of possession of a controlled substance after officers found a small amount of cocaine at his house.

Garay remained in the Ector County jail Wednesday on surety bonds totaling $104,000.
