Man charged with photographing up woman’s skirt

An Odessa Police Department probable cause affidavit details a 25-year-old man, who at the time was working for Subway at a local truck stop, followed a woman and used his phone to take photos of underneath her skirt.

Rogelio Efrain Gonzalez was charged with invasive visual recording, a state jail felony.

The incident was reported to OPD on Sept. 27, the affidavit stated. The complainant stated while she was visiting Love’s Travel Stop, located at 1901 Interstate 20, she was followed by a male Subway employee, identified as Gonzalez, who used his phone to take images beneath her skirt without her consent.

The complainant reportedly detailed to police that the incident took place around 4:40 p.m. Sept. 25. The complainant stated she confronted Gonzalez who put his phone away and walked away.

Management was contacted and Gonzalez denied the accusations before leaving the store, the affidavit stated. Management reports after the incident that Gonzalez was terminated as he did not return to work.

Video surveillance from Love’s Travel Stop was reportedly obtained and supported the accusations made by the complainant. At 4:37 p.m., the complainant is seen leaving the restaurant area of the truck stop to the partitioned area of the store’s cooler wall.

Gonzalez is seen walking behind the complainant with his cellular phone in hand, the affidavit stated. Gonzalez enters an aisle that was behind where the complainant was standing.

Gonzalez is reportedly seen kneeling down in the aisle as the complainant faced the cooler. After the complainant moves further down the aisle of the cooler to another cooler door, Gonzalez is seen with his cellular phone in hand moving once again behind the complainant kneeling down in an aisle with his phone facing the direction of beneath the complainant’s skirt.

The complainant reported she saw Gonzalez in the cooler window and watched his actions which resulted in her confronting him, the affidavit stated. Management of Love’s Travel Stop was contacted by OPD the date of the report and informed the surveillance was reviewed and is as reported by the complainant.

Gonzalez was booked into the Ector County Law Enforcement Center on Oct. 20, jail records show. Gonzalez had one bond totaling $3,000 and posted bail on Thursday.
