ECSO releases names of suspects in Monday night shooting of three deputies

Court records detail criminal charges ranging from marijuana possession to evading arrest for Damon Murad Asad who was killed Monday night in a gunfight with SWAT team officers in north Odessa.

Asad’s name and that of another man were released Thursday as the two involved in the shooting that hospitalized three deputies Monday.

Asad, 33, was identified as the gunman who was shot and killed after he reportedly opened fire on deputies who were there to serve a warrant, while Juan Antonio Andrade, 35, was taken into custody and charged with failure to identify, a class A misdemeanor.

Andrade was booked at 8:18 a.m. Tuesday in the Ector County Law Enforcement Center on a U.S. Marshals Hold, jail records show. Andrade was still in custody in Ector County on Thursday afternoon a jailer employee said over the phone.

Texas Department of Public Safety spokesperson Sgt. Oscar Villarreal said over the phone the Texas Rangers, who are investigating the shooting, completed its inspection of 7321 Kentucky Ave., home Wednesday where the shooting took place.

“(Texas Rangers) have collected their evidence at residence,” Villarreal said. “We are done there.”

Villarreal didn’t disclose any specific details about the shooting investigation. He said those details will be available once the investigation is complete.

Villarreal wouldn’t say how many times Asad was shot, what type of weapon he used or how many weapons he had.

ECSO deputies Josh Pool, 28, Cody Smith, 26, and Ricky Rodriguez, 28, were all reportedly shot by Asad. All three were treated and released from Medical Center Hospital less than four hours after being shot in the line of duty.

Pool is part of the special investigative unit, while Smith is a criminal investigation division investigator and Rodriguez is a reserve officer.

The three deputies were working as part of a SWAT team serving a search warrant for narcotics at 9:30 p.m. Monday.

ECSO spokesperson Sgt. Gary Duesler just say said told the Odessa American the three deputies were each hit once. Pool and Rodriguez were each shot in the leg, while Smith had a bullet graze his lip.

According to jail records, Asad has been booked into the Ector County Law Enforcement Center six times. The most recent arrest was Feb. 24, 2013, when he was charged with evading arrest or detention with a vehicle, evading arrest or detention and resisting arrest, search or transportation.

Ector County court records show evading arrest or detention in a vehicle was dismissed in 2014, while evading arrest and resisting arrest, search or transport were dismissed in 2015. He also had a driving while license invalid charge dismissed in 2003.

Asad pleaded guilty to possession of marijuana more than four ounces but not more than five pounds in 2008. On Jan. 29, 2007, Asad pleaded guilty to forgery and theft of property and was sentenced to probation, but that probation was revoked after the marijuana guilty plea. He also pleaded guilty to driving while license invalid in 2006.

Jail records show Andrade has been booked in a total of nine times. Prior to Tuesday’s arrest, Andrade was booked into the jail on Sept. 1 for driving while intoxicated by DPS. He had a pre-trial date set for 9 a.m. Jan. 22 in County Court.

In 2007, Andrade pleaded guilty to injury to a child, a third-degree felony, and was convicted of assault causing bodily injury (family violence), a class A misdemeanor, Johnson County court records show.
