Man pleads guilty to injury to child, receives 45 years in prison

A 20-year-old man pleaded guilty today to injury to a child, which resulted in the death of 2-year-old Zaydrian Guerra.

Marqalo Divonte Flores pled guilty to injury to a child, a first-degree felony, and he was sentenced to 45 years in prison.

The autopsy performed by the Lubbock County Medical Examiner’s Office is currently the subject of an unresolved investigation by the Texas Rangers.  The victim’s family supports this plea.

A probable cause affidavit from the Odessa Police Department stated Flores contacted officers about 12:06 a.m. Aug. 7, 2018, when he heard a loud thud from the room where the boy was sleeping. Flores told police he went to check on the boy and found him lying head first between the bed and the dresser. Flores reportedly picked up the boy and found that he was pasty and unresponsive. He said he tried to wake up the boy, but couldn’t, the affidavit detailed.

The document stated MCH emergency staff reported the boy had major brain bleed of the left frontal lobe. Flores denied ever assaulting the boy at any point of accidently dropping him, the affidavit stated.

A Child Protective Services worker advised a child abuse expert about the incident and the doctor said the boy had a brain hemorrhage and a bilateral retinal hemorrhage that is consistent with child abuse, the document detailed.
