An Odessa business and one of its employees are being sued by the family of an Anton man who was killed in a crash in May 2021.
According to the lawsuit, filed Wednesday in Ector County District Court, Ricardo Salas of Lovington, N.M. was driving a six-wheel cargo truck for Double A Contracting when he rear-ended a vehicle in front of him on a smoke-filled FM 168 on May 12, 2021.
Daniel Herrera was traveling north on FM 168 and came to a stop after coming upon the crash, but he was rear-ended by an 18-wheeler and mortally injured, the lawsuit stated.
Salas was cited for failure to control speed, but at the time of the collision he didn’t have a valid license and he had an outstanding warrant for failing to appear in a drug case, according to the lawsuit.
The lawsuit alleges Double A Contracting is “vicariously liable” for the damages caused by Salas because it hired Salas, allowed him to work without a valid license and failed to adequately train or supervise Salas.
Double A Contracting did not immediately return a phone call seeking comment.
The lawsuit was filed by the law firm of Faddoul, Cliff, Hardy and Conaway on behalf of Herrera’s wife, minor daughter and three adult sons.
