A man is in serious condition at Medical Center Hospital from a gunshot wound after he reportedly drove into another man’s fence several times, knocking it over onto the man.

Police responded to Graves Court around 2:03 a.m. Monday in reference to a disturbance, an OPD press release said.

Upon arrival, officers made contact with the 66-year-old complainant, the release stated, who told officers he had seen an unknown man walk past the window of his house.

The complainant reportedly grabbed a handgun and walked into his backyard to confront the prowler, 19-year-old Jerry Cuellar, the release detailed. Cuellar then got into a silver PT Cruiser parked in the alley, the complainant told police.

When confronted, Cuellar reportedly placed the vehicle into drive and began accelerating toward the complainant, colliding with the fence, the release said. The complainant then began discharging his firearm at Cuellar, thinking he was trying to run him over.

Cuellar then reportedly reversed the vehicle and drove toward the complainant, colliding with the fence again, and drove into it a third time, causing the fence to fall onto the complainant, the release said.

The complainant suffered minor injuries, the release detailed, and Cuellar sustained a gunshot wound and was taken to MCH with serious bodily injury.

OPD has made no arrests and are still investigating the incident, the release stated.
