Odessa firefighter fights City Hall

A civil trial pitting a former Odessa Fire Department captain against the City of Odessa will begin on Aug. 6, according to information from the federal district clerk’s office in Midland.

Former Capt. Pat Land claims in the lawsuit that the city attempted to hide an air quality report pointing to acetone as the cause of unexplained rashes at Barbara Jordan Elementary School in 2004.

The former captain claims he was fired after confronting another fire department official about the report.

Land is suing for reinstatement in his job with back pay and pension benefits.

The city is being defended by Odessa attorney B. Calvin Hendrick VII of the law firm Shafer, Davis, O’Leary and Stoker.

Land is being represented by the Wiseman, Durst, Owen and Colvin law firm in Austin and by Midland attorney Claudia Donaldson.

Donaldson said Land’s daughter McKenzie attended Jordan Elementary in 2004 and suffered from a rash.

Land’s attorneys declined comment, and efforts to reach Hendrick were unsuccessful.
