DNA testing done

A Department of Public Safety crime lab has completed DNA testing in the case of a youth pastor who has been charged with sexually assaulting a 15-year-girl.

Second Baptist Church of Odessa pastor Robert John Weber was indicted last year on nine counts of sexual assault of a child and one count of continuous sexual abuse of a child. The indictment accuses Weber of having at least three encounters with the girl in which he received and performed oral sex.

Assistant District Attorney Scott Layh said at a pre-trial hearing Monday that prosecutors are awaiting a report on the DNA findings and could have it within a few days. Court documents show prosecutors do not intend to make any plea offers until they receive the report.

Weber’s attorney, Jason Leach of Odessa, said Monday that no pre-trial motions are pending, but he requested more legible copies of witness statements, which Layh said he would provide.

State District Judge Bill McCoy said he will set a trial date after Layh receives the DPS report.
