The woman who accused 40-year-old Joe Alvarez Jr. of sexual assault has filed a protective order against the man, giving new details in the case.
Alvarez, who was arrested Sept. 21, is accused of assaulting and sexually assaulting the woman.
According to an affidavit filed with the protective order, the woman said she was at the YMCA to meet with a friend when Alvarez saw her and began pulling her hair and hitting her in the head.
Alvarez then pulled her out of her car by her hair, the affidavit stated, and put her in his mom’s vehicle, holding her by the hair the entire way to his home.
According to the affidavit, Alvarez then took out her phone, wanting to know who she was talking to, and began hitting her, “telling me I was being a slut and a hoe.”
The woman said in the affidavit that Alvarez continued to punch, slap and kick at her before sexually assaulting her.
When her phone rang, she said he tried to tear her shirt off, then pulled off her shorts and underwear and had sex with her, the affidavit stated.
“I was crying the whole time, then he said, ‘I might as well finish cause it’s another charge anyways,’” she said in the affidavit.
After washing up, the woman said she eventually got away from Alvarez and started running down her street screaming for help.
Alvarez was arrested and released Sept. 21 from the Ector County Detention Center on $35,000 bond.
