MIDLAND An attorney for the publisher of the Winkler County News has appealed an Aug. 14 decision by U.S. Magistrate L. Stuart Platt ordering Richard "Rick" Ellsworth McLaughlin to be held without bond.

The appeal for McLaughlin has been scheduled for 4 p.m. Sept. 9 in U.S. District Judge Rob Junell's court. A Wednesday morning hearing was rescheduled due to scheduling conflicts.

McLaughlin was arrested Aug. 7 outside his Kermit home. He faces a federal charge of possession of child pornography that officials say depicted children "of tender years."

According to court records, Platt ordered McLaughlin held without bond because "there is clear and convincing evidence that the defendant is a danger to the community."

McLaughlin once worked as a reporter for the Odessa American.
